Albany County District Attorney David Soares formally dropped an extortionate touching charge filed against former New York Gov. Andrew Cuomo accused a former colleague of groping him at the executive mansion, the only criminal charge he has faced tied to a wave of sexual assault. Misconduct allegations led to his removal from office last year.

Soares told Judge Holly Trexler that he did not think he could win the sentence in court, although he believed accomplice Brittany Comiso was a credible witness and that some evidence supported his allegations, according to The Associated Press,

Soares previously indicated he would drop charges following Westchester and Nassau prosecutors’ announcements that he would not pursue criminal charges against Cuomo.

Cuomo’s lawyer, Rita Glavin, claimed during a press conference on Friday that the groping allegations were “a political act.”
