Los Angeles County on Monday filed court documents seeking to dismiss a lawsuit filed by Vanessa Bryant, the widow of Kobe Bryant, who is suing the county for damages caused after sheriff’s deputies took unauthorized photos of the helicopter crash , in which her husband, daughter and seven others were killed.
The county argued that since the photos taken by the sheriff’s representatives were removed and were never leaked to the public, Bryant’s case has no basis.
“The damages cannot be based on speculation and conjecture,” county attorneys said in the motion. “If a photograph is published on day one would cause injury to the plaintiff … Until then, the non-existent speculative injury is not a ground for the negligent claim.”
The Mausers and Altobelis, the other families affected by the accident, received a joint settlement of $2.5 million from the county earlier this month after filing similar lawsuits as the Bryants.
