Theranos Founder Elizabeth Holmes Likely Faces September Sentencing

A joint filing by prosecutors and lawyers said Holmes could remain free on bail for at least the next eight months.

The filing, jointly filed by prosecutors and lawyers for Ms Holmes, said the government would take steps to dismiss the three hung cases. Both sides also proposed September 12 for Ms. Holmes’ sentencing, a date that needs to be signed by US District Judge Edward Davila.

If the offer is accepted, Ms Holmes will be out on bail for at least the next eight months. As of Tuesday’s filing, his $500,000 bond should now be secured by assets.

On each of the four counts that Ms Holmes was convicted of, a maximum sentence of 20 years in prison. A review of earlier cases indicates that there is likely to be less than 80 years of what could technically be encountered. Judge Davila, who oversaw the months-long proceedings, would be the final judge and, under federal sentencing guidelines, would have much leeway in sentencing.
